Mr.Tarun Prasad Mandal ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 08-01-2020 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Gogri P.S. Case No. 320 of 2019 for the offence registered under Sections 448, 341, 323, 325, 307, 379, 504 and 506 of the Indian Penal Code.

The allegation is regarding the father-in-law of the daughter of the informant having arrived at the house of the informant along with his son and others whereafter they are stated to have indulged in assaulting the informant and his wife by lathi and rod etc. resulting in injuries being inflicted on the informant and his wife.

The learned counsel for the petitioner has submitted that the fact is that the marriage of the daughter was solemnized with the son of the petitioner and after two months some matrimonial dispute had taken place whereafter the daughter of the informant had gone back to her parents home and thereafter

Patna High Court CR. MISC. No.85481 of 2019(2) dt.08-01-2020 2/2 the present case has been filed with oblique motive in order to falsely implicate and harass the petitioner and his family members. It is further submitted that the petitioner has been suitably punished inasmuch as he is languishing in custody since 20.09.2019. As far as the injury report is concerned, it is submitted that the opinion has been reserved by the docter on account of non-availability of the x-ray report etc. Having regard to the facts and circumstances of the case, considering the submissions advanced by the learned counsel for the petitioner as also taking into account the period of incarceration of the petitioner, I deem it fit and proper to grant regular bail to the petitioner herein.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Gogri P.S. Case No. 320 of 2019, G.R. No. 2817 of 2019. (Mohit Kumar Shah, J) S.Sb/- U T
