The petitioner seeks regular bail in connection with RPF/Post/Jamlpur (Workshop) Case No. 02 of 2019 for the offence registered under Section 3(a) of the RP (UP) Act Amendment, 2012.

The allegation is regarding railway property worth Rs. 4536/- being carried in an auto rickshaw and the petitioner was arrested while he was also found sitting in the said rickshaw.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is submitted that though the petitioner is an accused in two other

Lastly, it is submitted that the petitioner has already been suitably punished inasmuch as he is languishing in custody since 10.11.2019. Having regard to the facts and circumstances of the case, considering the submissions of the learned counsel for the petitioner as also considering the period of incarceration of the petitioner herein, I deem it fit and proper to direct for release of the petitioner herein on regular bail.

Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Kiul in connection with RPF/Post/Jamalpur (Workshop) Case No. 02 of 2019.
