WJC No.9 of 2026(4) dt.19-06-2026 2/3 mandamus seeking reliefs directing the respondents particular the respondents no. 4 and 6 to immediately institute/lodge a case against the respondents no. 7 and 8 who have committed the alleged occurrence and demanded bribe money of Rs.80,000/- (Rupees eighty thousand) for taking gratification by corrupt being the public servant whereby and where under the petitioner had already submitted his written report on 08.11.2025 to the effect of the alleged allegation of demand of bribe money but till today the F.I.R. has not been registered by the SHO of Kotwali P.S., District Patna, whereas it is a clear case u/s 198, 201, 229, 238, 256, 257 B.N.S. is being made out against the respondents no. 7 and 8.

(ii) For further the petitioner seeking relief directing the respondents particular the Senior Superintendent of Police Patna to personally enquire into the matter because there is serious allegation against respondents no. 7 and 8 who have indulged to demanded Rs.80,000/- bribe money being the public servant for taking gratification to drop the departmental proceeding against the petitioner to this effect the petitioner had already submitted his written report on 08.11.2025 before the SHO of Kotwali P.S.,

(iii) For any other relief/reliefs, order/orders, direction/directions may deem fit and proper in the facts and circumstances of this case."

02. From perusal of record I find the petitioner has already approached the court of learned Chief Judicial Magistrate, Patna by filing complaint case vide Complaint Case No. 16158(c) of 2025 for the same relief. Therefore, the present writ petition could not be entertained.

03. At this stage, learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to pursue his remedy before the learned trial court.

04. Permission is accorded.

05. Accordingly, the present petition is dismissed as withdrawn with liberty as aforesaid.
