However, case diary was called for in the present case.

The petitioner seeks bail in anticipation of his arrest in connection with Goraul P.S. Case No. 224 of 2019 dated 06.07.2019 instituted for the offences under Sections 414/34 of the Indian Penal Code. It appears that the petitioner has been made accused in this case on the statement made by the arrested accused persons that he was also part of the gang which was trying to sell machinery parts of Goraul Sugar Mill.

From the order impugned as also from

Patna High Court CR. MISC. No.85494 of 2019(3) dt.15-06-2020 2/2 paragraph-3 of the bail petition, it appears that the petitioner has criminal antecedent as well.

Regard being had to the nature of accusation against the petitioner, I am not inclined to grant anticipatory bail to him.

Accordingly, prayer for anticipatory bail is rejected.

However, if the petitioner surrenders before the court below, his case shall be considered without being prejudiced by the fact that, the present petition has not been entertained.
