JUSTICE MOHIT KUMAR SHAH ORAL ORDER 18-02-2021 The present writ petition has been filed for issuance of direction to the respondents to pay the death-cum- retiral dues pertaining to the husband of the petitioner, who died in harness on 10.09.2018.

During the pendency of the present writ petition, this Court has passed various orders, which has resulted in payment of the following retiral benefits, as has been mentioned in the various counter affidavits filed on behalf of the respondents :- " (i) G.P.F. amounting to a sum of Rs. 11,57,887.00.

(ii) G.I.S. amounting to a sum of Rs. 2,64,264.00. (iii) Leave Encashment amounting to a sum of Rs. 6,38,740.00"

The learned counsel for the respondent- State has further submitted that the Office of the Principal Accountant General (A & E), Bihar, Patna has also issued the Pension Payment Order and the

Patna High Court CWJC No.1820 of 2020(6) dt.18-02-2021 2/2 Gratuity Payment Order dated 01.05.2020, whereby and whereunder the gratuity amounting to a sum of Rs. 20 lacs has been sanctioned, apart from family pension having been sanctioned to the petitioner. The learned counsel for the respondent-State has also submitted that the aforesaid amount of gratuity and arrears of pension have also been paid to the widow-petitioner.

Having regard to the facts and circumstances of the case, the Superintendent of Police, Kaimur at Bhabua is directed to ensure that the aforesaid amount under the head of death-cum-retiral dues, specially the amount of Gratuity and arrears of pension/ current pension, have already stood paid to the widow-petitioner and in case, any amount has not been paid, it shall be incumbent upon the Superintendent of Police, Kaimur at Bhabua to ensure payment of the same to the petitioner within a period of four weeks from today, failing which he shall not draw his salary and shall also be liable to be prosecuted.

Accordingly, the writ petition stands disposed off, however with liberty to the petitioner to revive the present petition, in case of any subsisting grievances.
