The petitioner seeks bail in connection with Dhansoin P.S. Case No.100 of 2019 registered under Sections 379/411 of the Indian Penal Code.
The accusation is that the informant Bharat Singh purchased the Splender Motorcycle bearing Registration No.BR44B2479 from Mantu Sharma, resident of village-Chak Rahsi, P.S. Buxar, District-Buxar, on payment of Rs.27500/- but the paper of the same was not transferred in his name. On 05.07.2019, when the informant went to Dhansoui Market carrying the 'Khoa' (solid milk), loading on the motorcycle, and parked the same in front of the Sweet shop. In the meantime,
Patna High Court CR. MISC. No.86698 of 2019(2) dt.18-01-2020 2/2 one person started to flee away with the motorcycle of the informant, however, on chase, he was apprehended with the motorcycle of the informant, who disclosed his name as Jhandu Khan alias Raju Khan (petitioner).
Learned counsel appearing on behalf of the petitioner submits that, in fact, the petitioner had gone to Dhansoui Market to purchase the sweet and he was present in front of the sweet shop, near the motorcycle of the informant, but, on mere suspicion, the petitioner was caught hold by the informant and was handed over to the police with the allegation that he was fleeing away with his motorcycle. The petitioner has no criminal antecedent and is in custody since 06.07.2019. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-III, Buxar, in connection with Dhansoui P.S.
