Mr. Manoj Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 23-06-2020 Heard Mr. Suresh Prasad Bhakta, learned counsel for the petitioners and Mr. Manoj Kumar, learned APP for the State.
The petitioners seek bail in anticipation of their arrest in connection with Kateya P.S. Case No. 353 of 2019 dated 16.10.2019 instituted for the offences under Sections 147, 148, 149, 341, 323, 324, 307, 504 and 34 of the Indian Penal Code.
Patna High Court CR. MISC. No.87060 of 2019(3) dt.23-06-2020 2/2 The petitioners are said to have disturbed the work under the Nal Jal Yojna and also assaulted the informant and his associates.
It has been submitted on behalf of the petitioners that after 13 days of the occurrence, a complaint case was filed by opposite party no. 2 which became the subject matter of the present FIR. There is a counter version of the occurrence as well. One of the petitioners viz. Ram Pravesh Sah has also filed a complaint case against the informant with regard to an occurrence dated 04.09.2019.
The injuries also do not appear to be of any serious nature.
Considering the aforestated facts, the petitioners are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Gopalganj in connection with Kateya P.S. Case No. 353 of 2019, subject to the conditions as laid down under Section 438(2) Cr.P.C.
