This application, for grant of anticipatory bail, arises out of Bhagalpur Mahila Police Station Case No. 43 of 2018, disclosing offences under Sections 498(A), 341, 323, 504, 506, 34 of the Indian Penal Code.

The learned Counsel for the petitioner at the very outset has offered to pay monthly maintenance of Rs.3000/- per month to the Opposite Party No.2 during the pendency of the case.

Considering the aforesaid fact that there is allegations and counter allegations between both the parties which cannot be decided in the bail application, the application for anticipatory bail is allowed.

No.86506 of 2019(5) dt.08-12-2021 2/2 Let the petitioner, named above, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Bhagalpur, in connection with Bhagalpur Mahila Police Station Case No. 43 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure and subject to further condition that the petitioner shall pay maintenance of Rs.3000/- per month to the Opposite Party in her bank account or through money order, the receipt of which shall be supplied to her lawyer in the Court below and in case of default of payment, the bail bond of the petitioner shall be cancelled.

With the aforesaid observations and directions, this application is allowed.

The maintenance amount shall be subject to any order of maintenance passed by any competent Court. (Sandeep Kumar, J) sanjeev/- U T
