The petitioner apprehends his arrest in connection with Kamtaul P.S. Case No. 188/2018 registered for the offences punishable under Sections 341/323/498A/34 of the Indian Penal Code and Section 3⁄4 of the D.P. Act.
It is being submitted by learned counsel for the petitioner that he has paid Rs. 20,000,00/- (Rupees Twenty Lakhs) to the Opposite Party No. 2.
Despite serious efforts made by the learned counsel for the Opposite Party No. 2, the Opposite Party No. 2 is not present to support this fact.
Learned counsel for the petitioner has filed an affidavit
Patna High Court CR. MISC. No.86345 of 2019(6) dt.06-12-2021 2/2 in support of the fact that rupees twenty lakhs has been paid to the opposite party No. 2.
Learned counsel for the opposite party No. 2 has, on instruction, submitted that the money has been paid to her, but she is not coming for swearing the affidavit. Considering the aforesaid and in view of the compromise between the parties, no useful purpose will be served in keeping case pending before this Court.
As such, the F.I.R. in connection with Kamtaul P.S. Case No. 188/2018 registered for the offences punishable under Sections 341/323/498A/34 of the Indian Penal Code and Section 3⁄4 of the D.P. Act and the subsequent orders are hereby quashed. (Sandeep Kumar, J) Saif/- U T
