The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 30 (a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that there is recovery of 5373 liters of English wine from the truck and three other vehicles and there is no recovery from the conscious possession of the petitioner. The petitioner is owner of pick up van and he has given said pick up van to driver on contract of Rs. 25,000/- per month and not transported the vehicle nor he care about loading and unloading and in every month driver pay the consideration money. In the aforesaid facts and circumstances of the case, I am inclined to grant anticipatory bail to the above named petitioner, subject to deposit of Rs. 50,000/- (fifty thousand only) in the Juvenile Justice Fund of the State Social Welfare Department and on deposit of the aforesaid amount, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs. 20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional District and Sessions Judge-cum-Special Judge, Excise, Lakhisarai, in connection with Excise Case No. 307 of 2019 arising out of Lakhisarai P.S. Case No. 660 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
