The petitioner is accused in connection with Dinara P.S. Case No. 101 of 2019, registered under Sections 302 and 120(B)/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that it would appear from the FIR that on recovery of unknown male dead body in canal situated at village Jamrorh, Dinara P.S. Case No. 101 of 2019 was instituted against unknown on the basis of Fradbeyan of Chaukidar, Ram Ikwal Yadav and after six days, i.e., 15.04.2019, Lalan Singh, uncle of the petitioner, identified the same on the basis of photograph of dead body published in the newspaper saying that the dead body is his own brother, Ram Awadhesh Singh, who happens to be the father of the petitioner. No.86145 of 2019(2) dt.17-01-2020 2/2 used to reside in village with his brother, Lalan Singh and petitioner used to reside at Buxar and taking advantage of death of father of the petitioner, his uncle Lalan Singh, gave his statement before the police on 15.04.2019 with contention that this petitioner, being the son of the deceased, killed him and Lalan Singh, uncle of the petitioner, has given the name of the petitioner as assailant of his father, Ram Awadhesh Singh only to deprive the petitioner to inherit the property after late Ram Awadhesh Singh, father of the petitioner and grab the same. Further submission is that petitioner has no criminal antecedent and is in custody since 25.09.2019.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Bikramganj, Rohtas, in connection with Dinara P.S. Case No. 101 of 2019. Out of two sureties, one surety must be the close relative of the petitioner.
