====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 10-02-2026 Heard learned counsel for the petitioner and the State.
2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 8, 15, 18(c), 25 of the Narcotic Drugs and Psychotropic Substances Act.
3. As per F.I.R., this petitioner is alleged to be involved in cultivation of illegal opium plants.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Petitioner is not named in the F.I.R. and his name transpired during investigation only on the basis of confessional statement of coaccused. Petitioner has got no concern with the alleged recovery and the land in question does not belong to the petitioner. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State vehemently opposed
Patna High Court CR. MISC. No.1100 of 2026(2) dt.10-02-2026 2/2 the bail application.

Considering backdrop of the case, nature of accusation and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge cum Special Judge, NDPS Act, Gaya Ji in connection with Barachatty P. S. Case No. 50 of 2019, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
