The State is represented by Mr. Sanjeev Kumar Singh learned APP.

The petitioner seeks bail in anticipation of his arrest in connection with Bypass P.S. Case No. 300 of 2019 instituted for the offences under Sections 302, 506, 120B and 34 of the Indian Penal Code.

By way of a supplementary affidavit, learned counsel for the petitioner has brought on record the document demonstrating that eight persons have been

Patna High Court CR. MISC. No.86299 of 2019(4) dt.31-08-2021 2/2 charge-sheeted in this case whereas the petitioner has not been sent up for trial. Pursuant to the aforesaid police report, cognizance has been taken against the other eight accused persons.

Thus, sensing no apprehension of arrest, the petitioner seeks permission to withdraw this petition with the liberty that in case in future again cognizance is taken, the petitioner would have the liberty to approach this Court again.

The petition is permitted to be withdrawn.

There is no requirement of giving any liberty for an action in futuro. It goes without saying that if the petitioner would require any interference by this Court at any point of time, it would always be open for him to approach this Court in an appropriate forum.
