The petitioners apprehend their arrest in connection with Hasanpur P.S. Case No. 95/2018 registered for the offence punishable under Sections 307/379/385/323/341/506/147/148/ 149 of the Indian Penal Code.

Learned counsel for the petitioners prays for and is granted liberty withdraw the application as against petitioner No. 1 as he has been taken into custody.

It is thus dismissed as withdrawn.

Learned counsel for the petitioners submits that so far as the allegation against petitioners No. 3, 4 and 5 are concerned, the same is false and mischievous and they have had

Learned counsel for the petitioners further submits that so far as petitioner No. 2 (Ram Babu Kumar) is concerned, the allegation against him is that he had attacked the informant with the butt of the gun which injury has been found to be simple in nature and stands testified by Annexure-2.

Considering the aforementioned facts and circumstances and that these petitioners No. 2, 3, 4 and 5 have no criminal antecedents, let the petitioners above named be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate,-III, Rosera at Samastipur, in connection with Hasanpur P.S. Case No. 95/2018, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Anjana Mishra, J) Saif/- U T
