Mr.Ashok Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 14-01-2020 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with Kotwali P.S. Case No. 413 of 2019 for the offences punishable under Sections 3, 4, 5, 6 and 7 of the Immoral Trafficking Act. The allegation is regarding two accused persons including the petitioner herein having found to be taking a girl to a hotel with ulterior motive, however, after reaching the hotel in question, the hotel incharge did not give any room to the accused persons and the girl was saved from being subjected to any illegal act, whereafter the police had arrived and had arrested the petitioner.

The learned counsel for the petitioner submits that the

It is further submitted that petitioner is languishing in custody since 09.09.2019. It is further submitted that similarly situated coaccused person has already been granted bail by a co-ordinate Bench of this Court by an order dated 12.12.2019 passed in Cr. Misc. No. 82305 of 2019.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner and taking into account the fact that similarly situated co-accused person has already been granted bail and the petitioner is having a clean antecedent, I deem it fit and proper to direct for release of the petitioner on regular bail. Accordingly, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Kotwali P.S.
