The petitioner seeks regular bail in connection with Raushanganj P.S. Case No. 39 of 2019 for the offence punishable under Sections 25(1-AA)/25(1-b)A/26, 28 and 35 of the Arms Act.

The allegation is regarding the police having arrested two persons and upon search, one country made pistol was recovered from the co-accused, while one regular carbine and two live cartridges were recovered from the petitioner herein. The learned counsel for the petitioner has submitted that petitioner is innocent and he has been falsely implicated in the present case. It is further submitted that though the petitioner is accused in some other cases, but he is on bail in all the said

Patna High Court CR. MISC. No.85701 of 2019(3) dt.14-01-2020 2/2 cases. Lastly, it is submitted that the petitioner has been suitably punished inasmuch as he is in custody since 12.3.2019. Having regard to the facts and circumstances of the case and considering the submissions advanced by the learned counsel for the petitioner, I deem it fit and proper to direct for release of the petitioner on regular bail.

Accordingly, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghati, Gaya in connection with Raushanganj P.S. Case No. 39 of 2019.
