The petitioner's claim in the instant proceedings is for grant of benefits on account of 2nd ACP. He is a retired Assistant Settlement Officer and claims the benefit with effect from 09.08.1999.

The State counsel has brought the attention of the Court to the order dated 11.04.2019 bearing Memo No. 5066 issued by the General Administrative Department. It is submitted that the petitioner's claim can be considered in light of the order dated 11.04.2019.

Patna High Court CWJC No.803 of 2020(2) dt.05-07-2022 2/2 In view thereof, matter is disposed of, allowing the authorities to consider the petitioner's claim and pass final order there upon, granting the benefits dues and admissible to the petitioner in accordance with law.

Having regard to the decision of the State Government contained in order dated 11.04.2019, the petitioner's counsel submits that he would be approaching the respondent No. 4 (The Assistant Settlement Officer) with his claim along with a copy of this order as well as decision of the State Government contained in order dated 11.04.2019.

Writ application stands disposed of with the aforesaid liberty.
