JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-02-2020 Earlier prayer for bail of the petitioner was rejected twice by this Court firstly by order dated 6.11.2017 passed in Cr.Misc.No. 43699 of 2017 and secondly by order dated 11.4.2019 passed in Cr.Misc.No. 18546 of 2019 and petitioner is accused in two other cases also.
Submission of learned counsel for the petitioner is that so far this case is concerned, there is general and omnibus allegation and prayer for bail was earlier rejected on the ground that petitioner is accused in other cases also and co-accused persons have been granted bail by the then co-ordinate Benches of this Court by order dated 23.5.2017 passed in Cr.Misc.No. 18440 of 2017 and by order dated 24.4.2019 passed in Cr.Misc.No. 26586 of 2019 and petitioner is in custody for more than three years.

Patna High Court CR. MISC. No.85515 of 2019(2) dt.26-02-2020 2/2 Considering the period of custody, let petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Sri Gorakh Nath Dubey, Judicial Magistrate, 1st class, Sherghati, District Gaya, in connection with Amas P. S. Case No.
26 of 2014 on the condition that before releasing the petitioner the court below shall verify the address of the petitioner as well as address of the bailors and further condition that one of the bailors shall be a local person having sufficient immoveable property within the jurisdiction of civil court, Gaya and further condition that he has to appear before the trial court as and when required, otherwise prosecution is at liberty to move for cancellation of bail bonds of the petitioner and further petitioner has to appear before police station of his local area in second week of every month for a period of nine months, so that police may watch his activities and if active involvement of the petitioner is found in future in such type of cases, prosecution is at liberty to move for cancellation of his bail bonds.
