JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 21-01-2020 Learned counsel for the petitioners appears and submits that the petitioner no.1, namely, Ranjan Das alias Ranjan Kumar, has already been arrested by the police in this case and seeks permission to withdraw this application in respect of the petitioner no.1, namely, Ranjan Das alias Ranjan Kumar.

Permission is accorded.

This application in respect of the petitioner no.1, namely, Ranjan Das alias Ranjan Kumar, is dismissed as withdrawn. Now, only the prayer of the petitioner no.2, namely, Lakhan Das alias Ram Lakhan Das, to grant him the privilege of pre-arrest bail is being considered.

Patna High Court CR. MISC. No.3417 of 2020(2) dt.21-01-2020 2/3 Das, apprehends his arrest in connection with Shahkund (Sajour) P.S. Case No.199 of 2019 registered under Sections 307 and 325/34 of the Indian Penal Code besides Section 75 of the Juvenile Justice Act, 2015.

The accusation is that in the morning of 28.06.2019, Ranjan Das alias Ranjan Kumar along with his father, namely, Lakhan Das alias Ram Lakhan Das (petitioner no.2) took away the minor children, namely, Gulshan Kumar, son of Mahendra Sah, aged about 14 years, Dhananjay Yadav, son of Bholi Yadav, aged about 10 years and Piyush Kumar, son of Ajay Yadav, aged about 11 years, at the house of Raju Pandit for preparing the fodder after cutting the paddy straw through machine. In course of cutting the paddy straw through machine, Gulshan Kumar, the brother of the informant, sustained cut injury on his both hands and, thereafter, Gulshan Kumar was admitted at the hospital by the petitioner no.2 and his son and, then they fled away from the hospital.

On coming to know about the aforesaid occurrence, the informant along with his family members went at the hospital, then the informant saw that his brother Gulshan Kumar is under treatment. The petitioner no.2 and his son, namely, Ranjan Das alias Ranjan Kumar have three machines of cutting the paddy straw for preparing the fodder and they used to engage the minor children for cutting the paddy straw through machine for preparing the fodder and earn the money. Learned counsel for the petitioner no.

Patna High Court CR. MISC. No.3417 of 2020(2) dt.21-01-2020 3/3 fact, the machine of cutting the paddy straw for preparation of the fodder is being used by his son, namely, Ranjan Das alias Ranjan Kumar and the petitioner no.2 being the father of Ranjan Das alias Ranjan Kumar has falsely been implicated in this case. The petitioner no.2 has no criminal antecedent.

Having considered the facts and the circumstances of the case, let the petitioner no.2, namely, Lakhan Das alias Ram Lakhan Das, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Bhagalpur, in connection with Shahkund (Sajour) P.S. Case No.199 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C.
