JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-01-2020 This is an application for grant of anticipatory bail in connection with GRNo. 2680 of 2019 arising out of Sambhuganj P. S. Case No. 226 of 2019 disclosing offences under Sections 406, 409, 420, 467, 468/34 of IPC. Petitioner happens to be the Mukhiya of the Gram Panchayat. There is allegation of irregularities in the installation of solar light in the village.

Submission of the learned counsel for the petitioner is that she was elected in the year 2011-12, as such she is not responsible for the work conducting in the year 2010-11. It is further alleged that the solar lights are installed in the village and are still functioning. The solar lights installed in the village was cheaper than rather purchased by the District Development Commissioner.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of her arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of Additional Chief Judicial Magistrate-I, Banka, in connection with GR No. 2680/2019 arising out of Sambhuganj P. S. Case No. 226 of 2019, with condition that she has to appear before the I.O. as and when required and cooperate in the investigation of this case.
