The petitioner is in custody since 30.07.2019 in connection with Chiraiya P.S. Case No.380 of 2019 registered for the offence under Sections 326, 302 and 394 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner was not named in the F.I.R. but subsequently his name has come in the confessional statement of co-accused. Similarly situated co-accused, who had been named by the person arrested has been extended privilege of bail in Cr. Misc. No.835 of 2020 vide order dated 16.01.2020 by co-ordinate Bench of this Court. Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedent,

Patna High Court CR. MISC. No.758 of 2020(2) dt.20-01-2020 2/2 let the petitioner, above named, be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., East Champaran at Motihari in connection with Chiraiya P.S. Case No.380 of 2019.
