Petitioner is in custody in connection with Siwan Muffasil P.S. Case No. 398 of 2019 for the offence under sections 272, 273 of the Indian Penal Code and 30(a), 41(1) of Bihar Prohibition and Excise Act, 2018.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent and he is in custody since 23.10.2019.

In the instant case 79 liters of foreign liquor was recovered from a Tempo in which the petitioner was driver. Considering the fact that petitioner is in custody since 23.10.2019 and he has no criminal antecedent, the Court is inclined to grant bail to the petitioner, let the petitioner, named
