JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-02-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Bakhtiyarpur P.S. Case No. 322/2019 registered for the offences punishable under Sections 399 and 401 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act. Admittedly, neither petitioner was caught at the spot nor anything was recovered from his conscious possession. The name of petitioner was disclosed by those accused, who were caught on the spot.

Although, petitioner does have criminal antecedents but in the present case except so-called confessional statement of co-accused, there appears to be nothing against him.

No.87221 of 2019(2) dt.14-02-2020 2/2 Accordingly, it is ordered that petitioner, in the event of his arrest/ surrender within six weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Barh, District Patna/ concerned court in Bakhtiyarpur P.S. Case No. 322/2019 subject to conditions as laid down under Section 438(2) of the Cr.P.C.
