JUSTICE PARTHA SARTHY ORAL ORDER 24-07-2020 Heard learned counsel for the petitioner and learned APP for the State, through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Kurtha P.S. Case No. 60 of 2019 registered under sections 302, 304B and 34 of the Indian Penal Code.

As per allegation in the FIR, the sister of the informant was married to the petitioner about a year back. It is stated that she was done to death by the accused persons by making her consume poison and the accused persons fled away. It is submitted by learned counsel for the petitioner that the petitioner has no criminal antecedent and he is in custody since 2.5.2019. Charge has already been framed, but not a single witness has been examined.

The case diary and a report with respect to the stage of trial had been called for and the same have been received. From the report, it transpires that the charge was framed on 6.11.2019 and the trial is pending for prosecution evidence. Having heard learned counsel for the parties and taking into consideration the facts of the case including the statement of the witnesses recorded in course of investigation and the relationship of the petitioner with the deceased, the Court is not inclined to enlarge the petitioner on bail. The application for bail stands rejected.
