The petitioner being the Khalashi of a Truck is in custody since 12.10.2019 in connection with Guthani P.S. Case No. 162 of 2019 for the offence registered under Sections 420, 465 and 467 of the Indian Penal Code and Under Section 30 (a), 38(1) and 41(1) of the Bihar Excise and Prohibition Act, 2016.

Learned counsel for the petitioner submits that the alleged recoveries from the truck have nothing to do with the petitioner and he had been engage on the vehicle which was carrying potatoes. The boarding of liquor was not within the knowledge of the petitioner. Learned counsel for the petitioner is also filing a supplementary affidavit indicating the nature of illness of the present petitioner.

Judge (Excise), Siwan in connection with Guthani P.S. Case No. 162 of 2019.
