JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2020 This is an application for grant of anticipatory bail in connection with Ara Baruraj P.S. Case No. 202 of 2019 disclosing offence under Sections 290, 294, 272 and 273 of the Indian Penal Code and 30(a) and 37(b) of the Bihar Prohibition and Excise Act.

Recovery of 2 litres of liquor from the hut of the petitioner.

Submission of the learned counsel for the petitioner is that the hut is in open place without any phoose wall (Taati), and as such the same can be accessible to everyone. He has no criminal antecedent.

Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail.

In view of the submissions made above as well as

Patna High Court CR. MISC. No.2146 of 2020(2) dt.16-01-2020 2/2 the recovery of liquor, this application is disposed of with a direction to the petitioner to surrender before learned court below and pray for regular bail which will consider the same on its own merit, without being prejudice by this order, and if possible to be disposed of on the same day.
