====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 31-01-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is in custody in connection with Desari P.S. Case No. 298 of 2019 for the offenses under Section 395 of the Indian Penal Code.
Learned counsel for the petitioner submits that the allegation against the petitioner in the instant case is that he was involved in the loot of gold chain and silver articles and other valuable things worth Rs. 5,50,000/-. It is further submitted that the FIR was lodged against unknown persons. The petitioner is in custody since 13.09.2019.
Considering the fact that the petitioner is not named in the FIR, the Court is inclined to grant bail to the petitioner subject to cash deposit of Rs. 1,00,000/- (One Lakh) in the
Patna High Court CR. MISC. No.86190 of 2019(3) dt.31-01-2020 2/2 Court below and on deposit of the same, the Court below shall release the petitioner, above named, on bail on furnishing bail bonds of Rs. Rs. 1,00,000/- (One Lakh) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Desari P.S. Case No. 298 of 2019. However, it is made clear that the petitioner shall extend full cooperation for early disposal of the trial. In the event the petitioner fails to appear for two consecutive dates in the court below without any cogent reason, the court below shall be at liberty to cancel his bail. The cash deposit of Rs. Rs. 1,00,000/- (One Lakh) shall abide by the final outcome of the pending criminal case. (Anil Kumar Upadhyay, J) uma/- U T
