Petitioner in the present case is seeking regular bail in connection with Kuchaikote P.S. Case No. 157 of 2019 registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that the motorcycle in question from which illicit liquor has been recovered does not belong to the petitioner and nothing incriminating has been recovered from his possession as also that the petitioner is in custody since 04.12.2019 having no criminal antecedent.

Learned A.P.P. for the State has opposed the prayer for

Patna High Court CR. MISC. No.2150 of 2020(2) dt.16-01-2020 2/3 bail of the petitioner.

Considering the submission of learned counsel for the petitioner that the motorcycle in question from which illicit liquor has been recovered does not belong to the petitioner and nothing incriminating has been recovered from his possession as also that the petitioner is in custody since 04.12.2019 having no criminal antecedent, let the petitioner above named be released on bail on completion of statutory period of investigation in connection with Kuchaikote P.S. Case No. 157 of 2019 on furnishing of bail bond of Rs. 15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge II, Gopalganj, subject to the condition as laid down under Section 437 (3) Cr.P.C.
