JUSTICE MADHURESH PRASAD ORAL ORDER 04-07-2022 Petitioner has sought a direction on the respondent authorities to adjust/appoint the petitioner against Class-4 post in view of judgment and order dated 26.02.2016 passed by the hon'ble Apex Court in SLP (C) No. 32079/2015. Petitioner earlier was Non-formal Instructor posted in the district of Vaishali, Hajipur and is claiming adjustment/appointment under a scheme for adjustment/appointment of Instructors, like the petitioner, in view of closure of the Non-formal Education Scheme with effect from 31.03.2001.
Learned State counsel upon instructions, submits that
Patna High Court CWJC No.714 of 2020(3) dt.04-07-2022 2/2 in view of the decision of the Supreme Court dated 26.02.2016, petitioner's case is covered. In view thereof, the department has instructed that as and when vacancies are available, the claim of the eligible candidate is being considered in accordance with law.
In view of such stand of the respondent authorities, based on decision of the hon'ble Supreme Court (Annexure-3), it is not in dispute that no further order and direction are required, claim being admitted.
The writ application is disposed of in view of the stand of the respondent authorities.
