The petitioner seeks bail in connection with Special Case No.9617 of 2019, arising out of Nadi P.S. Case No.269 of 2019, registered under Section 30(a) of the Bihar Prohibition and Excise Act.

The accusation is of recovery of 1320 bottles, each containing 200 ml. country made liquor from the tempo, which was being driven by the petitioner. At that time, one person, who was sitting on the tempo, started to flee away but he was apprehended, who disclosed his name as Monu Kumar. Learned counsel appearing on behalf of the petitioner submits that, in fact, Monu Kumar, sat in the tempo, which was

No.87256 of 2019(2) dt.20-01-2020 2/2 being driven by the petitioner, on giving the signal for going to some distance with the bags containing the pouches of illicit liquor but, in the meantime, the tempo, which was being driven by the petitioner, was stopped by the police and the aforesaid recovery was made. The petitioner is in custody since 28.10.2019.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge Excise, Patna, in connection with Special Case No.9617 of 2019, arising out of Nadi P.S. Case No.269 of 2019.
