The petitioner seeks bail in a case registered for the offence punishable under Sections 414 of the Indian Penal Code and Section 8(C)/21 (a) of N.D.P.S. Act.
Prosecution case is that on 01.10.2019 the secret information about transportation of smack on a blue coloured Maruti Car 800. The informant informed the Sr. Official and reached at Arar More along with police team. The police party stopped the car but they trying to escape. They caught two persons from the said care and on interrogation, they disclosed their names as Keshav Prasad (petitioner) and Sahabuddin Ansari. After searching 10 pouch of brown powder are
Patna High Court CR. MISC. No. 2644 of 2020(3) dt.20-03-2020 2/2 recovered from the pocket of the petitioner and 2 pouch of brown powder are recovered from the dash board of said car. Total weight of recovered article was 2.7 gram. Learned counsel for the petitioner submits that there is recovery of 2.7 gram of smack from the possession of the petitioner which is below the small quantity. The similarly situated co-accused has been granted bail by the Co-ordinate Bench of this Court. The petitioner is in custody since 02.10.2019 and has got no criminal antecedent. Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-1, Gopalganj, in connection with Gopalganj Town P.S.
