2. Petitioner apprehends his arrest in connection with Bahera P. S. Case No.118 of 2000 registered for the offences punishable under Sections 406, 420, 467, 468, 408, 409/ 120B of the I.P.C.

3. The petitioner was posted as Block Development Officer at Benipur, District- Darbhanga in the Year 1997-98 and it is said that he along with co-accused Dhirendra Mishra, the then Panchayat Sewak and Ravindra Kumar Mandal defalcated Rs.57,000/-, which was meant for construction of a road.

4. Submission on behalf of the petitioner is that the occurrence is said to have taken place in the Year 1996-97, but the complainant filed complaint petition on 09.05.2000, which was converted into police case. However, after investigation,

No.1358 of 2020(2) dt.25-02-2020 2/2 police submitted chargesheet in the Year 2008 against two F.I.R. named accused persons whereas investigation against petitioner was kept pending. He further submits that petitioner recently got a message on his whatsapp to this effect that he has been made accused in the above stated case and having got aforesaid information, he immediately approached the Court.

Considering the aforesaid facts and circumstances of the case as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within six weeks from the date of receipt of this order to the Court concerned, shall be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Benipur, Darbhanga in connection with Bahera P. S. Case No.118 of 2000, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
