Petitioner is an accused in a case registered for the offence punishable under sections 393,342,34 of the Indian Penal Code and 27 of the Arms Act.
It is said that the four motorcycle borne armed miscreants reached at the shop of the informant and tried to snatch his bag and in course of the said offence, they opend fire causing injuries to the informant.
Learned counsel for the petitioner submits that though the petitioner has confessed his guilt, the FIR is against unknown and in course of investigation nothing incriminating has come to connect the petitioner with the offence. No TIP has been conducted till date and nothing has been recovered from the possession of the petitioner. It is further submitted that in fact in order to save the skin, the present case has been lodged in retaliation to Maker Police Station Case No. 143 of 2019, lodged by the uncle of the petitioner. Petitioner has got no criminal antecedent and he is in custody since 15.10.2019. In view of the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner,
Patna High Court CR. MISC. No.4133 of 2020(2) dt.22-01-2020 2/2 mentioned above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate XI1, Saran at Chapra in Derni Police Station Case No. 154 of 2019, on the following conditions:-
(1) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present as directed by the Court and on his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the Court below.
(2) If the petitioner tampers with the evidence or the witnesses, in that case the prosecution will be at liberty to move for cancellation of bail.
