The petitioner is languishing in custody for the offences punishable under Sections 8/20(b)(iii)(c)/29 of the N.D.P.S. Act.

Submission is that recovery of Ganja is alleged from other co-accused who were on the auto rickshaw. Allegation against the petitioner is that the petitioner was also in the same auto rickshaw. However, he fled away from the place of recovery. The petitioner has stated on oath that he has got no criminal antecedent. He is in custody since 28.09.2019.

Considering the fact that there is no material against

No.86000 of 2019(2) dt.14-01-2020 2/2 the petitioner as well as considering the fact that there is nothing to substantiate that the petitioner is going to tamper with the evidence or abscond the process of law, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Dholbajja (Kadwa) P.S. Case No.55 of 2019, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (c) The petitioner shall not leave the country without permission of the Court.
