Mr.Kumar Ranjit Ranjan ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-01-2020 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Sahebpur Kamal P.S. Case No. 312 of 2019 for the offence registered under Sections 413 and 414 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The allegation is regarding recovery of 101.625 litres of illicit English wine from the house of the petitioner. The learned counsel for the petitioner has submitted that the petitioner is innocent and has been falsely implicated in the present case. It is further submitted that the petitioner is languishing in custody since 22.10.2019.

Having regard to the facts and circumstances of the

No.2711 of 2020(2) dt.20-01-2020 2/2 case, considering the submissions made by the learned counsel for the petitioner coupled with the fact that the petitioner is having a clean antecedent, I deem it fit and proper to direct for release of the petitioner herein on regular bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Session Judge-IIcum-Special Judge, Excise Act, Begusarai in connection with Sahebpur Kamal P.S. Case No. 312 of 2019.
