JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-01-2020 Petitioner seeks regular bail in connection with Pirpainti P. S. Case No. 233 of 2019 registered for the offences punishable under Section 420 of IPC and Sections 27(b((ii), 28, 28A, 36 A.C. Drugs & Cosmetic Act, 1940.

Recovery of some scheduled drugs which has not entitled for sale, from the shop of the petitioner. Submission of learned counsel for the petitioner is that he is a license holder. His license is valid till 2021, which appear from Annexure 2. Further submission is that he is in custody for three months. Charge sheet has already been submitted, as such, there is no chance of tampering with the evidence.

Heard learned A.P.P. also.

No.1645 of 2020(2) dt.20-01-2020 2/2 Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.M.,XI, Bhagalpur, in connection with Pirpainti P. S. Case No. 233 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
