The petitioners are apprehending their arrest in connection with Lakhnaur P.S.Cae No.285 of 2019 dated 19.11.2019 registered for offences punishable under Sections 272 & 273 of the Indian Penal Code and Sectio 30(a) of the Bihar Prohibition and Excise Act, 2018.

There is recovery of 05 and odd ltrs. of liquor concealed in the earth beside the house of the petitioner. Submission of the learned counsel for the petitioners is that nothing has been recovered from the house and they have falsely been implicated in this case and there is no independent witness of the seizure list.

Patna High Court CR. MISC. No.86178 of 2019(2) dt.22-01-2020 2/2 Heard learned A.P.P. , who has opposed the prayer for bail of the petitioner.

Having heard both sides and considering the submissions as made above, I am not inclined to grant privilege of anticipatory bail to the petitioners, however, the petitioners are directed to surrender before the learned court below within a period of six weeks from the date of receipt of the order and make prayer for regular bail, which will be considered by the learned court below without being prejudiced by the order of this Court and if possible to be disposed of on the same day. With the aforesaid direction, this application is disposed of.
