The petitioner seeks regular bail in connection with Phulparas P.S. Case No. 489 of 2019 for the offence registered under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The allegation is regarding recovery of 737.640 litres of illicit Nepali countrymade liquor from a pick up van and the petitioner was apprehended while he was sitting in the said pick up van.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and he is having a clean antecedent. It is further submitted that the petitioner is languishing in custody since 27.11.2019. It is also

Patna High Court CR. MISC. No.86195 of 2019(2) dt.14-01-2020 2/2 submitted that the petitioner had taken a lift in the said vehicle and has got nothing to do either with the illicit liquor or with the pick up van.

Having regard to the facts and circumstances of the case, considering the submissions of the learned counsel for the petitioners as also taking into account the fact that the petitioner is having a clean antecedent and the vehicle does not belong to the petitioner, I deem it fit and proper to direct for release of the petitioner herein on regular bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-II-cum-Special Judge, (Excise) Act, Madhubani in connection with Phulparas P.S. Case No. 489 of 2019.
