The petitioner seeks regular bail in connection with Katoria P.S.Case No. 158 of 2018, registered for the offence punishable under Sections 147, 148, 149, 341, 323, 307, 504 of the Indian Penal Code and Sections 3/4/5 of the Explosive Substance Act.

The allegation is regarding the petitioner and other accused persons having assaulted the informant and are said to have hurled bomb on the prosecution party at the time when the informant and his son were constructing a hut in the jungle. The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case. It is further submitted that the petitioner is having a clean

Patna High Court CR. MISC. No.85789 of 2019(2) dt.14-01-2020 2/2 antecedent and he is languishing in custody since 27.10.2019. Lastly, it is submitted that the injury report annexed to the present petition would show that the injury on the son of the informant is simple in nature.

Having regard to the facts and circumstances of the case and considering the submissions made by the learned counsel for the petitioner, I deem it fit and proper to direct for release of the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Banka in connection with Katoria P.S.
