JUSTICE SHIVAJI PANDEY ORAL ORDER 19-03-2020 Heard learned counsel for the petitioner and the State. In this case, the petitioner is seeking bail in connection with Dighwara P.S. Case No. 248 of 2019 registered for offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the co-accused including the petitioner is to have demanded the extortion money and one coaccused Indal Singh has resorted firing causing injury on the head of son of the informant, who died on spot, however, counsel for the petitioner submits that though the petitioner has been named in the FIR but the specific allegation has been made against Indal Singh to have caused the injury, so he cannot be said to be involved in commission of death of the victim. He has further submitted that the petitioner was caught by the public

Patna High Court CR. MISC. No.434 of 2020(3) dt.19-03-2020 2/2 and was handed over to the police in Dighwara P.S. Case No. 247 of 2019 and from that case, he has been remanded in this case on 20.09.2019.

Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saran at Chapra in connection with Dighwara P.S. Case No. 248 of 2019 with a condition that if the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court/prosecution would be at liberty to take steps for cancellation of his bail bonds.
