Petitioner is apprehending his arrest in connection with Turkuliya P.S.Case No.645/19 , registered for offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 354, 379, 504 of the Indian Penal Code and Section 27 of the Arms Act.

As per the prosecution case, while the informant was showing paddy, the petitioner and several other accused persons came on two Tractors armed with Gun, country-made pistol and several other arms and tried to stop the informant from ploughing the land and there is allegation against one Ganesh Singh of assaulting by Garasi and also tried to disrobe to the wife of the informant and further allegation of firing is

Patna High Court CR. MISC. No.86217 of 2019(2) dt.22-01-2020 2/2 against the petitioner.

Submission of the learned counsel for the petitioner is that the FIR itself shows that no fire arm injury was received by any one and the injuries are simple in nature, which will appear from Annexure 3. There is also land dispute between the parties.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, East Champaran, Motihari in connection with Turkuliya P.S.Case no.645 of 2019, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
