JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 20-09-2022 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Complaint Case No. 2349 of 2018, registered for offence punishable under section 406 of the Indian Penal Code and Section 138 of the N.I. Act.

As per allegation, the petitioner borrowed Rs. 2,08,000/- from the complainant and he had given assurance to return that money within two months. He issued a cheque of Rs. 1,00,000/- in favour of the complainant, but that cheque was dishonoured by the bank due to insufficient fund.

No.239 of 2020(13) dt.20-09-2022 2/2 The learned counsel for the petitioner has submitted that the petitioner is ready to return Rs.2,08,000/- to the complainant within four equal monthly installments. Considering the above-mentioned facts and circumstances, the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail provisionally on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Complaint Case No. 2349 of 2018, subject to condition as laid down under section 438(2) Cr. P.C. The learned court below shall confirm the bail bond only after payment of entire installments within the stipulated period.

Accordingly, this criminal miscellaneous petition is disposed of.
