JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-02-2020 Petitioner seeks regular bail in connection with Rail Jehanabad (Taregna) P.S. Case No. 97 of 2019 registered for the offence punishable under Sections 395 and 397 of the Indian Penal Code.

As per FIR, allegation against the petitioner is that he was involved in robbery in the train. The petitioner was not named in the FIR but later on his name was surfaced in the case. The petitioner was identified by three witnesses in Trial Identification Parade.

Submission of the learned counsel for the petitioner is that as a matter of fact the petitioner is a booking clerk on contract basis. He reached the place of occurrence on hearing hulla in the train and tried to settle the dispute between the parties and due to that he has been made accused in the instant

Patna High Court CR. MISC. No.314 of 2020(3) dt.24-02-2020 2/2 case. Some of the witnesses also stated so. The petitioner is in custody since 14.11.2019.

Heard learned A.P.P. for the State who submits that on the ground of identification of three witnesses, the petitioner has been arrested in the instant case.

Considering the submissions of both the parties and in view of the facts stated above, I am not inclined to grant regular bail at this stage. However, the petitioner shall be at liberty to renew his prayer for bail after framing of the charge. Accordingly, this application is disposed of. (Vinod Kumar Sinha, J) uma/- U T
