JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2020 The petitioner seeks regular bail in connection with Bochaha P.S. Case No. 342 of 2019, registered for offences punishable under Sections 399, 402, 120(B) of the Indian Penal Code and Section 25(1-b)a, 26, 35 of the Arms Act. Prosecution case is that police on information that some persons are planning to commit dacoity, raided the place and arrested petitioner and other accused persons and there is recovery of country made pistol from co-accused Sonu Kumar and Manoj Sahni. Apart from that petitioner is a convict in one session trial for the offence under Section 302 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that so far this case is concerned, he has falsely been implicated in this case and nothing has been recovered from his possession and

Having heard both sides, considering the facts and circumstances of the case, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -14th Muzaffarpur, in connection with Bochaha P.S.
