JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-02-2020 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Danapur P.S. Case No. 493 of 2018, registered for the offence punishable under Sections 363, 366(A), 406, 379, 323, 504 and 506/34 of the Indian Penal Code.

The statement of victim has been recorded under Section 164 Cr.P.C. in which she stated that it was her step-

Patna High Court CR. MISC. No.86895 of 2019(2) dt.17-02-2020 2/2 father Mintu Jha who kidnapped and raped her. So far as petitioners are concerned, they are family members of aforesaid Mintu Jha but the victim has not whispered even a single word against the petitioners.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail is allowed and it is ordered that petitioners, above named, in the event of their arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Danapur, Patna in connection with Danapur P.S. Case No. 493 of 2018, subject to conditions as laid down under Section 438 (2) of the Cr.P.C. (Hemant Kumar Srivastava, J) Vikash/- U T
