The petitioner is accused in connection with Brahmpur (Krishnabrahm) P.S. Case No.363/2019 registered under Section 30(a) of Bihar Prohibition and Excise Act, 2018. The accusation is that in course of patrolling one motorcycle and one Scorpio were stopped. The person sitting in the Scorpio and the pillion rider of the motorcycle managed to flee away. The driver of the motorcycle was apprehended who disclosed his name Radhe Shyam Yadav and he disclosed the name of pillion rider as Jitendra Kumar Yadav (Petitioner). On search of Scorpio 55 cartoons each containing 48 piece each of 180 ml recovered.

Learned counsel for the petitioner submits that

No.477 of 2020(2) dt.20-01-2020 2/2 petitioner is not owner of the said Scorpio nor the name of the petitioner has been disclosed by Radhe Shyam Yadav, driver of motorcycle and he is in custody since 18.11.2019. The petitioner is accused in Brahmpur (Chakki) P.S. Case No.208/2010 registered under Section 379, 411/34 of the IPC due to that reason police implicated in this case.

Having regard to the facts and circumstances of the case, the, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional District & Sessions Judge, IIndcum-Special Judge, Excise, Buxar in connection with Brahmpur (Krishnabrahm) P.S. Case No.363/2019.
