Petitioners apprehend their arrest in connection with Raniganj P.S. Case No. 231 of 2019 for the offence registered under Sections 147/149/341/323/324/307/379/504/506 of the Indian Penal Code.

Learned counsel for the petitioners submits that the petitioners have falsely been implicated in connection with the present case due to enmity and personal grudge. There is no specific allegation against them. Further submission is that all

Patna High Court CR. MISC. No.4274 of 2020(3) dt.09-07-2020 2/2 the injuries are simple in nature. Further submission is that petitioners have no criminal antecedent.

Learned A.P.P. appearing on behalf of the State vehemently opposed the prayer of the petitioner no.1 Darpalal Yadav, by contending that he is named in the first information report and there is direct allegation against him. The injury also corroborates the same. Hence, this is not a fit case for anticipatory bail of the petitioner no.1.

Having considered the above facts and circumstances of the case, prayer of petitioner no.1 Darpalal Yadav, is rejected and let the petitioner nos. 2 to 4, above named, in the event of his arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on furnishing personal bail bonds to the satisfaction of C.J.M., Araria in connection with Raniganj P.S. Case No. 231 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
