The petitioner seeks regular bail in connection with Barharia P.S. Case No. 422 of 2019 for the offence punishable under Sections 272, 273, 308/34 of the Indian Penal Code and Sections 34(B)/ 36/ 38/, 30(a)/41(i) of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding recovery of 30 liters of illicit Mahua liquor from bushes and it is alleged that the petitioner had hidden the same and was selling it. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is further submitted that the is having a clean antecedent and is languishing in custody since 3.11.2019.

No.1600 of 2020(3) dt.20-01-2020 2/2 Having regard to the facts and circumstances of the case, considering the submissions advanced by the learned counsel for the petitioner coupled with the fact that the petitioner is having a clean antecedent and the illicit liquor has been recovered from the bushes, I deem it fit and proper to direct for release of the petitioner on regular bail. Accordingly, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-2nd cum Special Judge Excise, Siwan in connection with Barharia P.S. Case No. 422 of 2019.
