The petitioner is accused in connection with Pirbahore P.S. Case No. 509 of 2019, registered under Sections 25(1-b)a, 26 and 35 of the Arms Act.
The accusation is that in course of patrolling duty, two persons were apprehended in suspicion condition, who disclosed their names as Bikram Kumar and Krishna Kumar and they also disclosed that they have one pistol and the same is in possession of Chintu Kumar @ Shankar Yadav @ Roushan Kumar @ Sadhu. Thereafter, informant reached near Chintu Kumar @ Shankar Yadav @ Roushan Kumar @ Sadhu, who on inquiry, disclosed that he had handed the pistol to Bajrangi
Patna High Court CR. MISC. No.86683 of 2019(2) dt.18-01-2020 2/2 Kumar (petitioner). Thereafter, one country made pistol with magazine was recovered beneath the bed from the house of the petitioner.
Learned counsel for the petitioner submits that, in fact, the seized country made pistol with magazine has not been recovered from the conscious possession of the petitioner rather the same is recovered beneath the bed from the joint house of the petitioner. It is further submitted that petitioner has no criminal antecedent and is in custody since 29.09.2019. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna, in connection with Pirbahore P.S. Case No. 509 of 2019. Out of two sureties, one surety must be the close relative of the petitioner.
