The present restoration application has been filed for restoration of Criminal Misc. No. 70269 of 2019, which stood dismissed for non-compliance of the peremptory order, dated 06.11.2019.

Learned Counsel for the petitioner submitted that the defect, as pointed out by the Stamp Reporter, has been removed and the certified copy of the fresh First Information Report has been filed, as has been provided by the Office of the Special Judge, Excise, Bettiah. He further submits that the facts concerning the petitioner is already there in the First Information Report.
